Terms and Conditions

1) Buying through Main Line Railwayana Auctions Limited

a) Each Buyer is required to register with their correct name and permanent address.

b) All lots are “sold as seen” and any description given should be used as a guide only. All images, unless otherwise stated, are of the actual item that is to be auctioned and remain the copyright property of Main Line Railwayana Auctions Limited. It is the responsibility of the Buyer to thoroughly read the item description and view all associated images. Condition reports will only be provided upon request only. Viewing of any item is also advised but can only be accommodated strictly by appointment only. All bids are made on the basis that the Buyer has read and taken notice of the above.

c) Any lots handled by potential Buyers, is done so at the person’s own risk. Any loss or damage caused to a lot item, will incur an assessment of loss/damage cost by the Auctioneer whose decision will be final in the matter.

d) Electrical items should be considered untested, unless otherwise stated, and are only to be used at the risk of the Buyer.

e) The Auctioneer will have the discretion to refuse any bid and advance the bidding as they may decide. If there is any dispute, then the bidding will be reopened. At the fall of the hammer the highest bidder shall be contractually regarded as the purchaser of the item and liable for payment.

f) Commission bids are welcomed and will be accepted using the correct form. Commission bids containing an “And or if not successful” will not be accepted. These will be executed by the Auctioneer on a strict time and date received basis. All Commission bids must be received by 10am on the day of the commencement of the auction. The Auctioneer will however not be responsible for failure or neglect to carry out this process.

g) If, within seven working days, the Buyer gives notice in writing that, in their opinion with credible evidence to substantiate the claim, the item purchased is a deliberate forgery or fake, they must within fourteen days return the item to Main Line Railwayana Auctions in the same condition as sold in the sale. Where the claim of forgery/fake is accepted, the bid will be rescinded and the Buyer fully refunded.


2) Commission Charges for Buyers

a) All lots purchased are subject to buyer’s premium at 15% on top of the hammer price. No VAT is payable on top of the buyer’s premium.

3) Payment of Lots/Invoice

a) All items won must be paid for in full within five days of the sale ending and receipt of invoice. The Buyer will not legally own the item until payment in full has been made or the cheque has cleared.

4) Collection / Delivery

a) Buyers are expected to contact us within fourteen days of the completed payment, to arrange either collection or delivery of won lots. Failure to collect within this time or an alternative arrangement with us, will result in a storage charge of £1.50 per lot, per day until the storage fees equal the value of the lot. After this period the lot/s is/are forfeited and will be re-sold in the next available sale. The Buyer may be banned from future use of our services at our sole discretion and any payment made to Main Line Railwayana Auctions Limited may be deemed as forfeited and non-refundable with any goods reverting as being the property of Main Line Railwayana Auctions Limited.

b) All items should be inspected upon collection. Once items leave our premises, they are considered to have been accepted by the Buyer and no refund or return will be considered unless subject to conditions specified under 1(f).

c) Buyers should ensure that they have suitable assistance/equipment to load items into their vehicles, as assistance is not always possible. Buyers are to ensure that the vehicle used upon collection, can take the size and weight of the items purchased.

d) All buyers or vendors whether attending a sale or collecting, will be deemed to be at their own risk, on the premises or land used by the Auctioneer, and will have no claim against the company for any loss, accident of injury, however caused.

5) Selling through Main Line Railwayana Auctions Limited

a) Main Line Railwayana Auctions Limited currently accept suitable items from many Vendors and encourage you to contact us if you wish to consign items into our next auction.

b) Our current sellers commission is 10% of the hammer price, with a minimum lot value of £10. No VAT is payable on the Sellers commission.

c) We reserve the right to refuse entry of any or all items without explanation. Upon acceptance of auction entries, Vendors are required to complete the appropriate paperwork, clearly listing all items that are to be entered and the required Reserve Price. The setting of reserve prices should be realistic based on current market trends and conditions, considering any damage or condition of the item. Any defects or damage found, will be noted at this time and will be described accordingly within the auction catalogue.

d) The Auctioneer will reserve the right to divide any lots.

e) Reserve Prices will be set upon discussion with the Vendor, and advice at the time of entry. Any Auctioneer’s discretion to deviate from the reserve level will be discussed noted at this time.

f) The Auctioneer reserves the right to bid on behalf of the Vendor up to the reserve, but the Vendor may not bid on their own items either directly or indirectly.

g) If an item is sold by Private Treaty, both the Vendor and Buyer are bound by these terms and conditions, including any Auctioneer charges applicable to buying or selling.

h) Payments for items sold will be made to the Vendor within thirty days after the auction sale, via Bank Transfer.

i) Main Line Railwayana Auctions Limited disclaims liability and responsibility for the default by either the Buyer or the Vendor because it acts as agent for the Vendor only and therefore does not pay out to the Vendor until the corresponding payment has been received from the Buyer. Any instructions given by telephone are accepted at the sender's risk and must be confirmed in writing forthwith.

j) Confirmation of payment information will be collected at time of item entry and will be subject to and compliance with the Data Protection Act 2018.

k) All item entries are limited to a maximum of three auctions each. After each unsuccessful sale, we will contact you to discuss lowering the reserve price, altering the lot entry or to arrange a time for you to collect unsold items. Following this, items may not be entered again for a minimum period of 6 months. If items are not collected after seven days from the third entry, will be deemed as donated to the Auction House and any future sale of these items will be donated to a charity of our choice.

Main Line Railwayana Auctions Limited reserve the right to revise or amend these terms and conditions, as well as our buyers / sellers’ fees at any time. It is the responsibility of both Buyer and Vendor clients to check the Terms and Conditions prior to using our services.
